1. Identity of the Seller

2. Scope

These Terms of Sale apply to all sales of vintage watches to consumers via www.vintageseikos.nl.
For non-EU customers, specific sections regarding withdrawal rights may not apply (see Section 7).

3. Payment Terms

Accepted payment methods:

• PayPal (Goods & Services)
• PayPal Friends & Family — only by mutual agreement and explicit confirmation
• Stripe (including iDEAL, credit card, Apple Pay)
• Bank transfer — instructions provided upon request

Payment must be received in full prior to shipment.

4. Shipping Policy

Processing: 1 business day after payment confirmation.
EU / Eurozone: €25 (tracked, insured, signature required).
Worldwide: €40 (tracked, insured, signature required).

Packaging: Professional and secure.
Delivery: Signature required — ensure recipient availability.

5. Product Disclaimer

• All watches are vintage, typically over 20 years old.
• Unless stated as recently serviced, service history is unknown.
• Water resistance is not guaranteed, unless explicitly tested and certified in the listing.
• Normal wear, patina, or cosmetic imperfections inherent to vintage watches are not defects.
• Do not wear vintage watches during showering, swimming, or sports unless certified water-resistant.

Liability Notice

• We remain liable under Dutch and EU law for conformity at the time of delivery (Art. 7:17 BW).
• Usage contrary to care guidelines may void warranty and affect eligibility for refund.
• Damage arising from improper handling after delivery is not covered, unless otherwise agreed.

6. Reservation Service

• Reserve a watch with flexible monthly payments (€25 or €50 minimum).
• The reserved watch is held exclusively for you.
• You may change your reservation to another available watch at any time.
• Reservation payments are non-refundable unless otherwise agreed or in the event that the seller cancels the reservation.

7. Right of Withdrawal (EU Customers)

In accordance with the EU Consumer Rights Directive 2011/83/EU and Dutch law (Art. 6:230m BW), EU customers have the right to withdraw from their purchase within 14 calendar days of receipt of the item.

Inspection Guidelines

You may handle the watch as in a physical store:

Permitted:

• Visual inspection
• Brief handling to assess fit and aesthetics
• Time setting and winding check
• Short try-on for sizing

Prohibited:

• Extended wear (hours or days)
• Daily/lifestyle use
• Water exposure, shocks, or sports use
• Opening, modifying, or servicing the watch
• Resizing the bracelet

Legal Note:
You are liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods (Art. 14(2), 2011/83/EU).
Extended wear may invalidate your right of withdrawal or result in partial refund only.

8. Return Procedure (EU Customers)

To exercise your withdrawal right:

• Notify us within 14 calendar days of receipt via email (sales@vintageseikos.nl).
• Return the item within 14 calendar days after notification.
• Return shipping is at your expense.
• We will provide you with the specific return address upon your notification — returns must be sent to this address.
• Use original packaging and ship securely with tracking.
• Include all original accessories and documentation.

9. Return Exclusions

Returns are not accepted for:

• Goods customized or personalized at your request.
• Goods purchased via public auctions where the seller does not act as a professional trader.

10. Refund Policy

Full refunds apply if:

• Item is returned in accordance with the above guidelines.
• Item does not match the description or has undisclosed defects.
• A manufacturing fault is identified.

Deductions may apply for:

Handling & Use:

• Visible wear, scratches, or damage.
• Signs of extended use or water exposure.
• Attempts to open, modify, or service the watch.
• Resizing the bracelet

Administrative costs:
For PayPal Friends & Family transactions, any non-recoverable third-party costs may be deducted, but only if previously agreed in writing.
No restocking fee will be charged for returns under the statutory right of withdrawal.

Refund Timeline:

Refunds will be issued within 14 calendar days of receipt of the returned item in acceptable condition, using the same payment method as the original transaction.

11. Non-EU Customers

Customers outside the EU are not automatically entitled to EU withdrawal rights.
However, we aim to offer fair and transparent return options — please contact us to discuss your specific situation before purchase.

Customs Duties and Import Taxes (Non-EU Customers): If the return of a product from outside the EU results in import duties, customs processing fees, or taxes payable by us as the recipient, these amounts will be deducted from the refund. You are responsible for correctly declaring the return as a returned item to avoid unnecessary import costs.

12. Quality Assurance & Dispute Resolution

If we cannot resolve the issue, EU customers may use the European ODR platform for dispute resolution: https://ec.europa.eu/consumers/odr.

13. Legal Framework

These Terms of Sale are governed by:

• EU Consumer Rights Directive 2011/83/EU
• Dutch Consumer Protection Act (Wet bescherming consument)
• Dutch Civil Code (Burgerlijk Wetboek)

Where these terms conflict with mandatory consumer law, the applicable law shall prevail.

14. Modifications

These Terms may be updated periodically.
The version effective at the time of your purchase shall apply.
Customers are responsible for reviewing the current Terms before purchase.
